Dow closes above 14,000 for first time since 2007

An encouraging U.S. jobs report propelled blue-chip stocks to their highest level since October 2007 on Friday, closing above the closely watched 14,000 bulwark as investors momentarily sidelined their concerns about the recovery.

The government reported that nonfarm payrolls rose 157,000 in January, while the unemployment rate inched up by a tenth of a point, to 7.9 percent. The figures were broadly in line with Wall Street's expectations, and unlikely to change the Federal Reserve's plans to inject the economy with massive stimulus.

Indeed, some investors see the Dow's rally as a direct function of the Fed's efforts to reinflate the economy, rather than a product of the economy's fundamentals.

"Certainly given where interest rates are...the Fed is trying to push you into equities," said Eric Stein, portfolio manager at Eaton Vance. "There's a question of how much can we get with actual growth, given the fact that you have such a poor GDP print.

"The market wants QE," Stein said, speaking about the Fed's quantitative easing program, which is funneling about $85 billion a month via bond buying.

The Dow Jones Industrial Average rose by more than 150 points, ending the day above 14,000 ? its highest level in more than five years and less than 200 points away from an all-time high. The S&P 500 Index rose by about 15 points, ending above 1,513, while the the Nasdaq added nearly 37 points to close above 3,179. The averages posted their fifth consecutive week of gains.

Among sector leaders were telecoms and financials, with all ten S&P 500 large cap sectors trading higher. Dow components that also helped grease the wheels of the rally included Bank of America, United Technologies, Verizon and AT&T.

Friday's employment data was a welcome salve for some skittish investors who had begun to doubt the staying power of the recovery ? particularly in the wake of last quarter's surprising economic weakness. However, doubts about the significance of the stock market's rally continued to linger.

"It's not the big pop that one would think you'd get, and I for one think that's good," Jack Bogle, chairman and Founder of The Vanguard Group, told CNBC. He added that mutual funds piling into equities could be "a very negative sign for the market."

Pointing out that the Nasdaq is still "fully a third below its high", Bogle said that "the signs were mixed. I don't think the economic signs are going to change very much." He said he expects the economy to expand by 2-2.5 percent in 2013.

The rally was pushed higher by December construction data and better than expected U.S. manufacturing data, which confirmed generally buoyant global manufacturing data reported during overseas trading hours.

The employment report came as welcome news in a market that was jolted earlier this week by an unexpected contraction in the U.S. economy in the final months of 2012. While most corporate earnings have been stronger than expected, some market watchers have begun to worry that the recovery was losing steam.

Corporate America is in the thick of earnings season, most of which have met or exceeded expectations and helped keep a floor under major benchmarks. Still, most companies remain cautious about the outlook for 2013, as battles over taxes, spending and debt heat up in Washington with little immediate resolution in sight.

Oil and gas Exxon Mobil saw its fourth quarter profit surge by six percent, helped by stronger chemical and refining business and beating Wall Street's estimates. Exxon, which last week reclaimed the mantle of world's largest company from beaten-down tech giant Apple, saw its stock dip below $90 in modest trading.

Thus far, Apple is the S&P 500's worst performing stock, falling a steep 14.5 percent. In Friday's trading, the stock failed to mimic the gains of the broader stock market, little changed on the day near $455.

Excitement over the Dow's rally helped drag other stocks higher, such as Google, which briefly set a new all time high just as Apple remains mired near its lowest levels in a year. The search giant's shares traded above $774 in afternoon trading before scaling back.

Merck saw its profits rise in the latest quarter, but issued a cautious 2013 outlook that said revenues would likely fall in line with last year's levels. The less than ringing forecast sent its shares down by more than three percent, to below $42.

In a season where several major retailers have reaped the wages of a disappointing holiday shopping season, toy maker Mattel reported earnings that fell short of Wall Street's expectations. The company reported profits of $1.12 per share, three cents below estimates, with revenues also failing to meet forecasts. The stock rose modestly, trading above $38.

Zoetis roared in its market debut on the New York Stock Exchange, in the market's largest IPO since Facebook's flotation. The former animal health unit of drug behemoth Pfizer, sold 86.1 million shares at $26 in its spinoff Thursday night. In Friday's trading, the stock jumped by 19 percent, trading just shy of $31.

McConnell on immigration, guns, bourbon and Ashley Judd

Senate Minority Leader Mitch McConnell this week expressed firm support for a guest worker program to help bring in more low-skilled workers for farm labor and other industries.

In an exclusive interview with Yahoo News, the Kentucky Republican said any legislation pushed by the Senate ?Gang of Eight? must include such a provision.

?We need a good guest worker program. The one we have now is not working very well,? McConnell told Chief Washington Correspondent Olivier Knox, noting it was difficult for farmers to harvest crops without such low-wage assistance. "So there?s a practical reality to needing a guest worker program, and I?m sure that will be a part of the final bill.?

McConnell?s comments are significant given that a guest worker program, which would allow an employer to sponsor a non-U.S. citizen as an employee for labor purposes, has been opposed by labor unions and others who see it as a threat to low wage U.S. workers.

McConnell did not endorse any of the principles the bipartisan Senate group has outlined, including an eventual path to citizenship for millions currently living illegally in the U.S. He emphasized instead that the group is moving Congress in a "direction" toward reform.

"I think there?s a bipartisan desire to do something important here, a feeling that our immigration system is broken ? it certainly is," McConnell said.

McConnell spoke to Knox about a range of subjects in the 20-minute interview, from President Barack Obama's State of the Union address to what he thinks of Vice President Joe Biden to a potential political challenge from Ashley Judd to how the Kentucky senator likes his bourbon.

McConnell said he is skeptical about whether to pass new gun restrictions in the wake of the school shootings in Newtown, Conn., and elsewhere.

Calling himself ?a strong Second Amendment supporter,? McConnell cast doubt on the government's ability to help prevent gun violence by enacting gun reform.

"These school shootings are just horrendous. It absolutely shocks and appalls everybody in the country," McConnell said. "The question is: What can the government do about insane people doing horrendous things? It's a very complex question."

McConnell declined to say whether he supports expanded background checks for prospective gun buyers -- something Obama has championed.

The president has made gun safety restrictions a signature issue for his second term following the Newtown shooting. The president chose Biden to head up the task force to help craft legislative proposals to stem gun violence and gather input from a range of special interest groups, the public, advocates and others.

Biden, a 36-year veteran of the Senate from Delaware, has been a key negotiator for the president on Capitol Hill.

McConnell notably helped reach a New Year's Eve deal to avoid the so-called fiscal cliff by reaching out to Biden.

"What is it that former Senator Biden brings to the table in a negotiation like this that the president himself doesn't?" Knox asked.

McConnell joked that Biden wasn't "freelancing," suggesting Obama was well aware of what the vice president was doing in the negotiations with McConnell.

McConnell suggested Obama had recently missed a major opportunity to unite lawmakers behind his agenda.

"I was disappointed in the inaugural speech, which was very much on the far left," McConnell said. "I hope that the president will use the State of the Union to move back to the political center so we can do some important things for the American people."

Knox told McConnell that many Yahoo readers had said on Facebook and Twitter that they were interested in McConnell's reaction to a widely reported comment he made in 2010, when he said his No. 1 goal was to make Obama a "one-term president."

McConnell said he made those comments before the 2012 race, ?as any active Republican would," but that he was willing to work with Obama now that he has been re-elected to a second term.

McConnell claimed Wednesday that the president's plan to use the government to help boost the economy was a failure and that the economy has been "tepid for four straight years."

"Most of what he's done hasn't worked," McConnell said.

That claim conflicts with data showing that under Obama the economy has added jobs and corporate profits have grown, and with other positive factors that show an economy in a slow but gradual recovery despite a slight contraction in the gross domestic product in the fourth quarter of 2012.

McConnell acknowledged he may face a tough primary challenge in 2014, in part because he has been at odds with tea party members in his state and because those in Senate leadership roles in both parties are juicy targets for defeat.

Could that mean a Sen. Ashley Judd, who is considering running for the Democratic nomination in Kentucky?
"Who I actually end up running against either in the primary or the general will be determined in 2014 and we'll take a look at it then," McConnell said.

One thing McConnell was eager to discuss: bourbon, the drink his home state is known for.

"The best way to drink it, in my opinion, is to make a Manhattan, which is a combination of bourbon and other unknown substances,? McConnell said. ?Drop a couple of cherries on top of it, make sure there's ice there, and it's a terrific drink around Christmastime, which I frequently offer to my guests."

Pakistan court summons anti-corruption boss

ISLAMABAD (AP) ? Pakistan's top court on Thursday summoned the government's anti-corruption chief over a letter he wrote criticizing the tribunal's judges, the latest in an ongoing tussle between the judiciary and the country's political leadership.

The development is also an indication that the anti-corruption chief, Fasih Bokhari, could be charged with contempt of court.

Chief Justice Iftikhar Chaudhry on Thursday issued a court order for Bokhari to appear before the tribunal on February 4 to explain the letter, which the official wrote earlier this week to President Asif Ali Zardari.

In the letter, Bokhari accused Supreme Court judges of trying to influence Pakistan's upcoming parliamentary elections.

Chaudhry said the letter amounted to interference in court matters and was an effort to incite against the judiciary.

If we don't react to this adequately, "people will lose confidence in the courts," he said, adding that the Supreme Court wanted to know why Bokhari went to such lengths as to write a letter to the president.

Chaudhry stressed that the top court fully backs the holding of free and fair elections, and that no one will be allowed to derail the democratic process.

Bokhari's clash with the judiciary stems from his refusal in mid-January to arrest Prime Minister Raja Pervaiz Ashraf over a corruption case involving kickbacks allegedly taken by the premier.

Bokhari refused to arrest Ashraf, citing lack of evidence.

The Supreme Court has repeatedly clashed with the government over the past few years.

The court last year convicted the prime minister's predecessor, Yousuf Raza Gilani, of contempt and ousted him from office for refusing to reopen an old corruption case against the president.

NPD: iTunes Leads The Race In Online Video On Demand [Report ...

Awhile back it was reported that the iTunes Store is one of the biggest media companies in the world. The iTunes Store generated $8.5 billion in revenue last year, which is more than many of America?s top media companies combined.

Apple has been the tech industry?s pioneer for abandoning physical media, and iTunes is a testament to the success of digital downloads. According to a new report from the NPD Group, iTunes dominates its competitors in terms of online video on demand.

Netflix is winning the subscription-based game, but iTunes leads the race in digital movie purchases and rentals. TV show rentals from the pay-TV operators like Showtime accounted for over two-thirds of video on demand rentals. That?s probably because you can?t really get them anywhere else, at least not yet. Apple is rumored to be working on a TV subscription service that would allow you to pay for channels without the interference of a traditional cable or satellite provider.

Full digital movie purchases (not rentals) accounted for a small segment of the video on demand market at only?16%. Customers clearly prefer to rent or stream content.

Apple is the biggest player in internet-based video on demand (iVOD) with iTunes:

Screen Shot 2013-01-31 at 7.13.56 PM

Surprisingly, physical DVD sales aren?t suffering as badly as you would think. Apple has clearly bet against physical disks by removing optical drives in its Macs, but the disk is not dead. At least not yet. Companies like Redbox (who has also gotten into the streaming game) are doing very well.

?There is a significant base of video customers in the U.S. who continue to be comfortable with physical formats, and a large majority haven?t made the complete transition from discs to digital video,? according to NPD. ?For the time being, at least, consumers still like to own and rent movies and TV shows on DVD and Blu-ray, even in a world of where connected devices and digital rental, streaming, and ownership options are becoming more accepted and commonplace.?

This probably has a lot to do with the fact that content providers have yet to successfully adapt their business models to the internet. Looking at you, HBO.
